Terms and Conditions

By creating an account or using Frikshin ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and Bruce Miklós Salamon, entrepreneur individuel, SIRET À PRÉCISER, domicilié au 15 Rue de la République, 77590 Bois-le-Roi, France ("Frikshin", "we", "us", "our").

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You may use Frikshin if:

• You are at least 15 years old (minimum age under French law)
• You are not prohibited from using the Service under applicable law
• You have not previously had your account terminated by us for a violation of these Terms

Frikshin is a personal journalling and self-reflection tool. It allows you to:

• Log friction, conflict, and interpersonal situations
• Track outcomes (positive/negative resolutions)
• Access a library of coping frameworks (CBT, DBT, ACT, and others)
• Request AI-generated analysis of submitted journal entries via the Anthropic Claude API

Frikshin is not a medical or mental health service. It is not a substitute for professional therapy, counselling, crisis support, or medical advice.

If you are in crisis, please contact a crisis service in your country. In France: 3114 (numéro national de prévention du suicide, available 24/7).

4.1 Account Creation — You must provide accurate information when creating your account. You are responsible for maintaining the security of your password and for all activity that occurs under your account.

4.2 Account Security — Notify us immediately at hello@frikshin.com if you suspect unauthorised access to your account. We are not liable for losses arising from your failure to secure your account credentials.

4.3 One Account Per Person — Personal accounts are for individual use. You may not share your account with others or create accounts on behalf of others without authorisation.

You agree to use Frikshin only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable laws or regulations
• Submit content that is abusive, harassing, threatening, or harmful to others
• Attempt to gain unauthorised access to the Service, our systems, or other users' accounts
• Reverse engineer, scrape, or extract data from the Service using automated means
• Use the Service to generate, distribute, or store illegal content
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any commercial purpose without our prior written consent

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6.1 Ownership — You retain full ownership of all journal entries, notes, and other content you create in Frikshin ("Your Content"). We do not claim any intellectual property rights over Your Content.

6.2 Licence to Us — By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely to provide the Service to you. This licence ends when you delete your content or close your account.

6.3 AI Analysis — When you submit content for AI analysis, you are directing us to transmit that content to the Anthropic Claude API on your behalf. This is part of the Service and covered by our Privacy Policy. You retain ownership of what you submit; AI-generated analysis responses are provided as part of the Service.

6.4 Content Responsibility — You are solely responsible for Your Content. We do not review journal entries before storage. We are not liable for any content you create, submit, or store through the Service.

7.1 What we provide — Frikshin uses artificial intelligence, specifically large language models provided by third-party AI providers, to generate analysis, reframes, and coping suggestions based on the entries you log. This AI-generated content is provided for self-reflection and personal growth purposes only.

7.2 What AI-generated content is not — AI-generated content is not:

• Professional medical advice, diagnosis, or treatment
• Professional psychological, psychiatric, or therapeutic advice
• Professional legal advice
• Professional financial advice
• Advice from a qualified relationship counsellor, coach, or mediator
• A substitute for consultation with a qualified professional

The AI can be wrong, incomplete, or miss important context about your situation. It has no memory of you beyond what you explicitly log, and no awareness of the third parties you describe.

7.3 Your responsibility — You are solely responsible for how you interpret AI-generated content, any actions you take based on it, and any decisions informed by it. You should seek appropriate professional advice where your situation warrants it.

You agree that you will not act on any AI-generated suggestion that could harm you physically or mentally, harm another person, damage property, or constitute a criminal offence or civil wrong under any applicable law. If any AI-generated content suggests such an action, disregard it and report it to us at hello@frikshin.com so we can investigate and improve our safeguards.

7.4 Limitation of liability for AI content — To the fullest extent permitted by law, Frikshin, its founder, its officers, and its AI providers accept no liability for the accuracy, completeness, or appropriateness of AI-generated content, or for any decisions, actions, or omissions you make based on it, or for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or reliance on AI-generated content.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, or for fraud.

7.5 Data and AI processing — Your entries are sent to our AI provider, Anthropic, for processing. Anthropic does not use your data to train their models. See our Privacy Policy for full details on data handling.

8.1 Free Plan — The Service is currently available free of charge during the open beta period. We reserve the right to introduce paid plans at any time, with reasonable notice.

8.2 Paid Plans — When paid plans are introduced: Subscriptions are billed in EUR in advance on a monthly or annual basis; Prices are displayed inclusive of applicable TVA where required; You authorise us to charge your payment method on a recurring basis until you cancel.

8.3 Cancellation — You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods unless required by applicable law.

8.4 Refunds — Refund requests are considered on a case-by-case basis. Contact hello@frikshin.com within 14 days of a charge if you believe it was made in error. Your statutory rights under French consumer law are not affected.

8.5 Free Trials — If we offer a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. We will remind you before conversion.

8.6 Price Changes — We will give you at least 30 days' notice of any price change. Continued use after the effective date constitutes acceptance.

8.7 BYOK — If you choose to use your own Anthropic API key, you are responsible for all usage costs charged by Anthropic under your own account. We are not responsible for any charges from Anthropic.

9.1 Our IP — Frikshin, including its software, design, features, coping frameworks library, and brand ("Frikshin"), is owned by or licensed to Bruce Miklós Salamon and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

9.2 Feedback — If you submit ideas, suggestions, or feedback about the Service, you grant us a royalty-free, irrevocable licence to use that feedback for any purpose without compensation to you.

The Service integrates with third-party services including Anthropic (AI analysis), Supabase (database), Vercel (hosting), and Google (OAuth). Use of these services is subject to their respective terms. We are not responsible for the acts or omissions of third-party providers.

11.1 Availability — We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11.2 Changes to the Service — We may modify, add, or remove features at any time. We will endeavour to give reasonable notice of significant changes. Continued use of the Service after changes constitutes acceptance.

11.3 Beta Features — Features marked as "beta" are provided as-is and may be unstable, incomplete, or discontinued without notice.

12.1 By You — You may close your account at any time via your account settings. Upon deletion, your journal data will be permanently deleted within 30 days (see our Privacy Policy for details).

12.2 By Us — We may suspend or terminate your account immediately if: You breach these Terms; We are required to do so by law; Continued provision of the Service to you poses a risk to us or other users. Where possible, we will give you notice and an opportunity to remedy the breach before termination.

12.3 Effect of Termination — Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including Sections 6, 7, 9, 13, 14, and 15) shall continue to apply.

TO THE EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE
• AI-GENERATED CONTENT IS PROVIDED WITHOUT WARRANTY OF ACCURACY OR FITNESS FOR ANY PURPOSE
• FRICTION JOURNAL IS NOT A MEDICAL DEVICE AND MAKES NO THERAPEUTIC CLAIMS

Nothing in these Terms limits your rights under French consumer protection law (Code de la consommation).

TO THE EXTENT PERMITTED BY APPLICABLE LAW:

• OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) €50
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL
• WE ARE NOT LIABLE FOR DECISIONS YOU MAKE BASED ON AI-GENERATED CONTENT

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under French law.

These Terms are governed by French law (droit français). We encourage you to contact us first at hello@frikshin.com to resolve any disputes informally. If we cannot resolve a dispute within 30 days, it shall be submitted to the competent courts of France. As a consumer in the EU, you may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or a prominent in-app notice at least 14 days before the change takes effect. If you do not agree to the updated Terms, you must stop using the Service and may close your account before the effective date.

Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

Severability — If any provision is found unenforceable, the remainder of the Terms remains in full force.

No Waiver — Our failure to enforce any right or provision is not a waiver of that right.

Assignment — You may not assign your rights under these Terms without our consent. We may assign ours in connection with a business transfer or restructuring.

Language — These Terms are written in English. A French translation will be made available. In case of conflict, the French version shall prevail for consumers resident in France.
